About

David is a commercial lawyer with extensive experience working with clients on projects involving complex contractual structures and arrangements. He advises a wide range of public sector entities and large corporates on all aspects of commercial law, with a focus on contracting, procurement, technology and intellectual property.

David's clients call on him to advise on projects involving the acquisition, licensing, supply and support of large-scale defence, information technology, and telecommunications systems, and other goods and services. He provides support on all aspects of the contracting life-cycle, including in relation to the selection of contractual structures, contract drafting, tender development and evaluation, contract negotiations, contract management and disputes.

KEy Experience

  • Government technology contracting: providing extensive assistance to government clients with the drafting and negotiation of a broad range of technology contracts, including in relation to hardware acquisition and installation, SAAS, XAAS, data migration, telecommunications, managed services, development services, systems integration and software support services;
  • Significant military acquisition projects: closely supporting the Commonwealth government on a project to acquire and support a significant Army capability;
  • Privacy Advice: advising various public sector and private sector clients on privacy law compliance, including in relation to requirements under the Privacy Act 1988 (Cth), the Privacy and Personal Information Protection Act 1998 (NSW), and the EU General Data Protection Regulation;
  • Network Infrastructure for Victorian Public Hospitals: assisting a Victorian public sector client with the preparation of a Collective Agreement for the provision of Cisco network infrastructure, software, hardware maintenance services and hardware managed services for all Victorian public hospitals;
  • Mobile phone provider: providing extensive regulatory and commercial advice to a mobile carrier, including drafting its suite of consumer terms and conditions;
  • ERP software development and upgrade project: assisting a public authority with the drafting and negotiation of a software development and support contract for a bespoke upgrade and customisation of its enterprise resource planning system;
  • German automotive manufacturer: providing extensive regulatory advice to in relation to the Australian operations of a German automotive company, including in respect of the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) and the National Consumer Credit Code; and
  • Licensing agreements for a South African Start-up: advising a South African start-up on the localisation of its software licensing agreements for use in the Australian market.
