Jeremy Cummings

About

Jeremy is a regulatory and dispute resolution lawyer. He manages a broad practice advising clients in the government, financial services, insurance, and defence and aerospace sectors. His major clients include Commonwealth entities and Australian Financial Services Licensees.

Jeremy has extensive experience acting for Commonwealth clients in litigated matters, including administrative review and regulatory enforcement proceedings before the Administrative Appeals Tribunal and the Federal Court of Australia. He also advises on major projects and Defence acquisitions, providing strategic advice in relation to contracting, contract management and dispute resolution throughout the project life cycle.

In addition to his Commonwealth work, Jeremy advises and acts for commercial clients in a range of regulatory matters and disputes, including insurance disputes (with a particular focus on financial lines, product liability and specialty insurance claims), financial services matters, consumer law matters, intellectual property disputes, and general commercial litigation.

Jeremy holds an LLM (International Law) from the Australian National University, with a focus on trade, investment, and private international law.

Jeremy is a Sessional Academic at the ANU College of Law and has previously served as a Lecturer in Financial Regulation at Charles Sturt University.

  • Advising Commonwealth regulators on investigations and civil penalty proceedings before the Federal Court of Australia, relating to contraventions of financial services, funds management and directors’ duties laws;
  • Advising financial institutions and AFS Licensees in relation to ASIC investigations and enforcement actions (including administrative / delegate banning orders and responding to ASIC notices);
  • Advising financial institutions and AFS Licensees in relation to regulatory compliance, including AFS Licensing, issuing and dealing in financial products (including debentures), compliance frameworks and reviews, and the operation of relevant legislation;
  • Advising and acting for insurers and policyholders in claims indemnified under professional indemnity policies against a variety of professionals (including legal practitioners, engineers and AFS Licensees), product liability claims (including advising on associated regulatory issues arising under the Competition and Consumer Act 2010), directors and officers liability matters, and coverage / indemnity proceedings (including disputes relating to policy exclusions, non-disclosure and misrepresentation);
  • Advising and acting for various professionals including legal practitioners and financial planners in proceedings before professional regulators;
  • Advising Commonwealth government entities (including the Department of Defence) in relation to commercial disputes contract management issues arising in major projects, with a focus on technology projects and complex systems acquisitions;
  • Advising Defence industry companies in relation to import and export controls, including advising on the requirement and application process for licences and permits, and liaising with regulators;
  • Acting for Commonwealth government entities in administrative review proceedings before the Administrative Appeals Tribunal and the Federal Court of Australia;
  • Acting for clients in intellectual property disputes, including copyright and trade mark infringement claims;
  • Advising and acting for a variety of private clients including financiers, property developers, and large and small corporations in commercial and debt proceedings;
  • Advising Commonwealth agencies and AFS Licensees in relation to privacy and data protection (including the Privacy Act 1988 and GDPR); and
  • Advising AFS Licensees in relation to a variety of commercial transactions, including the appointment of authorised representatives, and the issue and distribution of financial products.
