Rachel is a public law, regulatory and dispute resolution lawyer. She has extensive experience advising government, commercial and private sector industry clients on the operation of government schemes and programs, challenging or defending government decisions, regulatory compliance and enforcement issues, and privacy and information law matters.

Rachel’s litigation experience includes representing clients in a range of complex and strategically significant matters across areas such as anti-dumping, research and development, tertiary education, migration and citizenship.

Rachel has particular experience representing the Commonwealth in merits and judicial review proceedings and has regularly appeared as a solicitor-advocate for the Commonwealth in substantive merits review proceedings.

Rachel has also advised clients on governance, risk management, administrative decision-making, policy development and legislative development and reform matters. This work has included advising on the functions, powers and duties of government entities under various legislative frameworks and instruments.

KEy Experience

  • Acting for the Minister for Home Affairs in over 100 migration and citizenship proceedings;
  • Advising and acting for the Department of Industry, Science, Energy and Resources in Research and Development Tax Incentive Scheme proceedings and complex anti-dumping litigation;
  • Advising Commonwealth regulators in relation to the exercise of compliance and enforcement powers;
  • Acting for a Commonwealth regulator in proceedings concerning the contravention of a civil penalty provision;
  • Advising and acting for a Commonwealth department in relation to numerous summonses, subpoenas and notices for non-party production issued to it by various Tribunals and Courts around Australia for the compulsory production of protected sensitive and personal information;
  • Acting for a Commonwealth department in complex debt proceedings against two insolvent private tertiary education providers concerning the providers' entitlement to payment under the former VET FEE-HELP Scheme;
  • Advising Commonwealth entities in relation to administrative decision-making, including statutory interpretation;
  • Preparing privacy advice and Privacy Impact Assessments for various Commonwealth entities, including in relation to social security payments and services and data matching activities;
  • Assisting Commonwealth entities in relation to Royal Commissions and Coronial Inquests;
  • Advising an Australian company on food contamination and food recall issues;
  • Acting for various Commonwealth entities in freedom of information proceedings; and
  • Advising Commonwealth entities on legislative and policy development.
